ASSITABET COSMETICS SALES CONTRACT

1.⁠ ⁠PARTIES

This Sales Contract (“Contract”);

has been concluded between ASSITABET COSMETICS (“Seller”) and the person who shops from www.assitabetcosmetics.com website (“Buyer”) under the following terms and conditions. 

2.⁠ ⁠SUBJECT

This contract regulates the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law No. 6502 and the relevant legislation regarding the sale and delivery of the products that the Buyer orders electronically from the Seller’s www.assitabetcosmetics.com website. 

3.⁠ ⁠PRODUCT AND DELIVERY SUBJECT TO THE CONTRACT

3.1. The Buyer agrees to purchase the products for which he/she has placed an order and completed the payment process via www.assitabetcosmetics.com.

3.2. The features, quantity, price, payment terms and delivery information of the products are presented to the Buyer during the order and these terms become binding between the parties with the approval of the order.

3.3. The products are delivered to the cargo within X business days at the latest from the date of order. The cargo process may vary depending on the delivery address.

3.4. The delivery is made to the address provided by the Buyer during the order. The Seller is not responsible for any delays that may occur due to incorrect or incomplete address declaration. 

4.⁠ ⁠PAYMENT AND BILLING

4.1. Payment will be made using one of the methods specified by the Seller.

4.2. The Seller may accept credit card, bank transfer or other payment methods.

4.3. The products will not be shipped unless the payment is completed.

4.4. The Seller shall perform the invoice issuance process in accordance with the legal regulations and send the invoice prepared according to the information provided by the Buyer to the Buyer. 

5.⁠ ⁠RIGHT OF WITHDRAWAL AND RETURN CONDITIONS

5.1. The Buyer may return the product within 14 (fourteen) days from the date of receipt of the product within the scope of the distance sales contract without giving any reason by exercising the right of withdrawal.

5.2. In order for the right of withdrawal to be valid, the products must be unused, their packaging must be intact and in a resalable condition.

5.3. Due to hygiene rules, the return of opened, used or custom-made products is not accepted.

5.4. The shipping fee in return transactions may vary depending on the reason for the return. If the product is defective or sent incorrectly, the shipping fee is covered by the Seller. Otherwise, the shipping fee belongs to the Buyer. 

6.⁠ ⁠WARRANTY AND LIABILITIES

6.1. The Seller undertakes that the products sold comply with all applicable legal regulations.

6.2. If a manufacturing defect is detected in the products, the Buyer may request the replacement or return of the product by notifying the Seller.

6.3. The Seller is not responsible for problems arising from improper use of the products or use contrary to the instructions. 

7.⁠ ⁠PRIVACY AND PROTECTION OF PERSONAL DATA

7.1. The Seller undertakes to protect the Buyer's personal data within the scope of the current KVKK (Personal Data Protection Law) and not to share it with third parties.

7.2. The Buyer accepts that the personal information shared while placing an order through the website will be used by the Seller for the processing, delivery and customer relations services of the order. 

8.⁠ ⁠FORCE MAJEURE

8.1. Neither party can be held responsible if it fails to fulfill its obligations under the contract due to force majeure such as natural disasters, epidemics, fire, war, strike, technical failures.

8.2. If the force majeure situation lasts longer than 30 (thirty) days, one of the parties may terminate the contract. 

9.⁠ ⁠RESOLUTION OF DISPUTES

9.1. In disputes that may arise from this contract, the laws of the Republic of Turkey shall apply and the Consumer Arbitration Committees and Consumer Courts where the consumer resides shall have jurisdiction.

10.⁠ ⁠ENFORCEMENT

10.1. By placing an order through the website, the Buyer declares that it has read, understood and accepted the provisions of this contract.

10.2. This contract shall enter into force upon electronic approval by the Buyer.
